CAREFULLY BEFORE USING THE E-MAIL SERVICE (“SERVICE”). BY USING THE SERVICE YOU AGREE TO BE BOUND

AND CONDITIONS OF THIS POLICY, YOU SHOULD NOT USE THE SERVICE.
MEMBER ACCOUNT, PASSWORD, AND SECURITY
To register for the American Industrial Real Estate Association (“AIR”) Service, you must first provide current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify AIR immediately of any unauthorized use of your account or any other breach of security of which you become aware. AIR will not be liable for any loss that you may incur as a result of someone else’s using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by AIR or another party due to someone else’s using your account or password. You may not use anyone else’s account at any time.
NO UNLAWFUL OR PROHIBITED USE
You agree not to use the Service for any purpose that is illegal, unlawful, or malicious, or otherwise prohibited by this policy. You may not use the Services in any manner that could damage, disable, overburden, or impair any part of the Service (or the network(s) connected to the Service) or interfere with any other party's use and enjoyment of any part of the Service. You may not attempt to gain unauthorized access to any part of the Service, other accounts, computer systems or networks connected to any part of the Service through hacking, password mining or any other means.
USE OF SERVICE
The Service is designed to enable you to communicate with others. You agree to use the Service only to post, send and receive messages and material that are proper. AIR has no obligation to monitor the Service. However, AIR reserves the right to review your use of the Service and to remove any materials in its sole and absolute discretion. In addition to pursuing all other remedies available to it at law or in equity, AIR reserves the right to terminate your access to any or all of the Service at any time, with or without notice, for any reason whatsoever. AIR further reserves the right at all times to disclose any information as AIR deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in AIR’s sole discretion. AIR shall have no obligation to maintain any content or to forward any unread or unsent messages to you or any third party.
By way of example, and not as a limitation, you agree that when using the Service, you will not:
NO SPAM; DAMAGES
AIR will immediately terminate any account that it believes, in its sole discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk email. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated, then in addition to seeking any other remedy available to AIR at law or in equity, you agree to pay AIR liquidated damages of $5 for each piece of spam or unsolicited bulk email transmitted from or otherwise connected with your account.
Designation of Agent
In accordance with Section 512 of the Digital Millennium Copyright Act (the “Act”), AIR has designated the following individual as an agent to receive notifications of any claimed infringements covered by the Act:

In accordance with the Act, AIR may disable access to the Service or remove content that appears to infringe the copyright or other intellectual property rights of others. If you believe that AIR or any user of the Service has infringed your copyright, please provide AIR’s Agent with all information required under the Act.
MODIFICATION OF THESE TERMS OF USE
AIR reserves the right to change the terms, conditions, and notices under which the Service is offered, including but not limited to the charges associated with the use of the Service. You are responsible for regularly reviewing this policy. Your continued use of the Service after such notice constitutes your agreement to all such terms, conditions, and notices.
